These Terms & Conditions ("Terms") govern the use of marksscarsfightgears.com (the "Website") and any business transactions initiated through it, between Marks & Scars Fight Gears ("we," "us," "our," "the Company," "the Seller") and any business entity submitting an inquiry, RFQ, or order ("Buyer," "you"). By accessing this Website or submitting an inquiry, you agree to be bound by these Terms.
This Website is strictly a business-to-business (B2B) wholesale manufacturing and export platform. Marks & Scars Fight Gears manufactures and exports sports and combat sports equipment for distributors, gyms, federations, promotions, and corporate buyers.
Retail sales, single-unit purchases, or individual consumer (B2C) transactions are not offered or entertained through this Website. All inquiries are treated as wholesale/bulk sourcing requests. Marks & Scars Fight Gears reserves the right to decline any inquiry that does not meet the Company's minimum business qualification standards for a B2B trade relationship.
Nothing on this Website constitutes a direct offer for sale to the general public. All content, product listings, and specifications are for informational and sourcing purposes only and are subject to confirmation via formal quotation.
Minimum order quantities, where applicable to a specific product line, will be communicated at the quotation stage.
Payment terms are not standardized on this Website and must strictly align with the terms set out in the mutually signed commercial contract or Proforma Invoice for each specific order. Commonly accepted terms include, but are not limited to:
No verbal payment arrangement shall be considered binding. Only payment terms explicitly stated in the signed Proforma Invoice or commercial contract shall govern the transaction. Marks & Scars Fight Gears reserves the right to withhold production or shipment until agreed payment milestones are received and confirmed.
All goods undergo internal quality inspection against the agreed specifications, materials, and sizing confirmed in the order documentation prior to packing and dispatch.
The Buyer is responsible for inspecting the cargo promptly upon arrival at the destination port/warehouse.
Any claim relating to manufacturing defects, quality issues, or mismatches between delivered goods and agreed specifications must be reported to Marks & Scars Fight Gears in writing within fifteen (15) calendar days of the cargo's arrival at the destination port, and must be accompanied by:
Claims submitted after the 15-day window, or without supporting photographic/video evidence, may not be accepted.
Upon receipt of a valid claim, Marks & Scars Fight Gears will review the evidence and respond within a reasonable period with a proposed resolution, which may include replacement of defective units, credit adjustment on a future order, or another mutually agreed remedy. Claims relating to normal wear and tear, damage caused during onward transit/handling after delivery, or deviations within accepted industry tolerances (e.g., minor color variation in leather/PU materials) are not considered manufacturing defects.
Should a dispute not be resolved through direct good-faith negotiation between the parties within a reasonable period, either party may pursue formal resolution in accordance with Section 8 (Governing Law & Jurisdiction) below.
To the maximum extent permitted by applicable law, Marks & Scars Fight Gears's total liability arising from any order shall not exceed the value of the confirmed Proforma Invoice for that specific order. Marks & Scars Fight Gears shall not be liable for indirect, incidental, or consequential losses, including loss of business, loss of profit, or reputational damage, except where such exclusion is not permitted under applicable law.
Marks & Scars Fight Gears shall not be liable for delays or failures in performance resulting from causes beyond its reasonable control (force majeure), including but not limited to natural disasters, port closures, customs delays, carrier disruptions, or raw material shortages.
These Terms, and any dispute, controversy, or claim arising out of or relating to any order, quotation, or transaction with Marks & Scars Fight Gears, shall be governed exclusively by the laws of the Islamic Republic of Pakistan, and the parties agree to submit to the exclusive jurisdiction of the courts of Sialkot, Pakistan, regardless of the Buyer's country of origin or destination of goods.
Marks & Scars Fight Gears reserves the right to update or revise these Terms at any time. Changes will be reflected by the "Last Updated" date above. Continued use of the Website or submission of a new inquiry after changes are posted constitutes acceptance of the revised Terms. Orders confirmed prior to a revision remain governed by the Terms in effect at the time of confirmation.
